Entry Condition Report

An Entry Condition Report describes the standard of repair for the premises and items included with the premises, such as furniture. The completion of an Entry Condition Report is in the interests of both parties. It enables lessor/agents to support legitimate claims in respect of damage to premises beyond fair wear and tear. It also protects tenants from claims that are not substantiated.

The Act provides that the report is evidence of the condition of the premises and inclusions.

A Tribunal may use the report as evidence if there is a dispute about the bond or condition of the premises at the end of the tenancy.

The report is to be completed by lessors/agents and tenants at the start of the tenancy.

Extra pages may be attached to the report if required. Extra pages should be signed by all parties to the tenancy.

The lessor/agent must give the tenant a copy of the Entry Condition Report on or before the occupation date. The tenant must return a copy of the report to the lessor/agent within three days, after the occupation date.

The lessor/agent must provide the tenant with a copy of the final report, which has been signed by both parties.

The RTA does not require a copy of the Entry Condition Report unless a dispute arises either during or at the end of the tenancy.

Exit Condition Report

This report is to record the condition of the premises at the end of the tenancy. This form is completed by the tenant.

A copy of the completed form needs to be printed. A copy must be given to the lessor/agent and the tenant should keep a copy for their records. The tenant should check that the lessor/agent understands they must return a signed copy to them within three business days.

Upon receiving the copy of the form the lessor/agent is required to inspect the premises and comment on any item where they disagree with the tenant’s report or where they believe the report does not reflect the true condition of the premises.

The lessor/agent then returns a signed copy of the each page to tenant within three business days.
